Article 1 Scope and Definitions
-
These Terms set out the conditions for use of the SceneDrafter app (the "App") provided by Quartet Labo LLC (the "Operator") through an app distribution store (the "Store"). These Terms apply to the App distributed through the Store and its associated account and entitlement-verification services. Account provisions apply to features offered in a supported version and platform.
-
In these Terms, the following terms have the meanings below.
(1) User: a person who uses the App.
(2) Basic Features: features of the App that may be used free of charge, regardless of whether the user has an entitlement to Additional Features.
(3) Additional Features: features of the App provided, in addition to Basic Features, during the valid period to a user who has a valid entitlement obtained through a subscription or an in-app item purchase.
(4) Project: data that brings together the content and settings of a scene created or edited in the App so that it can be saved and loaded.
(5) Created Data: projects created or edited in the App, imported assets, exported images, and similar materials. This includes work in progress.
(6) Bundled Assets: 3D models, images, textures, fonts, and other data bundled with the App for use in creation and editing in the App.
(7) Additional Assets: 3D models, images, textures, fonts, and other data that a user adds, including by importing them into the App, for use in creation and editing.
(8) Assets: Bundled Assets and Additional Assets collectively.
-
These Terms apply to the use of the App's Basic Features and Additional Features.
-
The license to use the App provided through Apple's App Store (including the Mac App Store; the same applies below) is governed by the Apple Licensed Application End User License Agreement (Standard EULA). In that case, these Terms supplement App-specific features, purchases, handling of Created Data, and similar matters, and are not a custom EULA that replaces the Standard EULA. If there is a conflict regarding the scope of the license, the Standard EULA applies, and if there are mandatory provisions of applicable law, those provisions prevail.
-
Use of the Store and transactions through it are governed by the Store's terms. For the App Store, transactions with Apple and use of an Apple Account and the App Store are separately governed by the Apple Media Services Terms and Conditions.
Article 2 Conditions of Use
-
Users shall review and agree to these Terms before using the App. Use of and purchases for the App through the Store require satisfaction of the conditions prescribed by that Store.
-
If a minor uses the App, the consent of a person with parental authority or other legal representative required under applicable law shall be obtained. If the App is used for an organization, it shall be used with the necessary authority and within the licensed scope.
-
Supported operating systems, required devices, and provided features are indicated on the product page of the distributing Store or in in-app notices. Communication charges and other costs of the usage environment are borne by the user.
Article 2-2 App Accounts and Login Methods
-
App account registration is optional. Google, Apple, or Unity Player Accounts registration for the App is not required solely to use Basic Features or supported App Store purchases and restoration with the same purchasing Apple Account. A purchase-store account is separately required.
-
Supported versions let users sign in with Google, Apple, or Unity Player Accounts and add login methods to their current App account. Each external login provider's terms apply to its service. Users shall manage available login methods and protect their credentials appropriately.
-
We do not forcibly move a login method already linked to another account or merge accounts solely because their email addresses match. To recover the same account, use a login method linked to it.
-
Unlink a login method through the confirmation screen while keeping another verified, available login method linked. The last available method cannot be unlinked. Unlinking does not delete the external provider's account or the App account, sign you out, transfer a purchase, or cancel a subscription.
Article 3 Basic Features and Additional Features
-
The App has Basic Features that may be used free of charge and Additional Features that may be used through a subscription or an item purchase. The content of each feature and any limitations on use are displayed on the product page of the distributing Store or in the App.
-
Even when using Additional Features, constraints due to device performance, the usage environment, and similar factors may apply.
-
Future Additional Assets or features, and support for other platforms, are not included in a current purchase unless their provision is expressly stated.
Article 4 Purchase of Additional Features
-
Additional Features may be used through an auto-renewing monthly or annual subscription, or through a paid or free item purchase. Price, usage period, and other conditions of use are displayed on the purchase screen or in the App.
-
Purchases and payments are made through the purchase provider (Store or web purchase service). The Mac version uses the Mac App Store. Pro for Windows uses a web purchase page opened from the App, outside the Microsoft Store. Item purchases and subscriptions are each treated as independent purchases.
-
A subscription automatically renews unless cancelled by the deadline prescribed by the purchase provider. Deleting the App, stopping use, signing out, unlinking a login method, or deleting the App account does not cancel the subscription.
-
Cancellation, refunds, and price changes follow the conditions and procedures prescribed by the purchase provider and applicable law. These Terms do not limit rights that users have under law.
Article 5 Use of Additional Features
-
If the entitlement to Additional Features is lost because the usage period ends or for other reasons, only Basic Features may be used. Saved Created Data is not deleted. However, restrictions may apply to editing, saving, and similar operations on already created data.
-
Use of Additional Features requires confirmation of the entitlement over a network. If confirmation remains unavailable, use of Additional Features may be restricted.
Article 5-2 Purchase Sharing and App Account Deletion
-
Where purchase sharing is supported, valid entitlements for the same App account are verified by the server to provide Additional Features on supported devices. Eligible purchases, devices, and features follow in-app notices. This Article does not promise availability of platforms or features not yet offered.
-
Sharing an Apple purchase with an App account requires explicit confirmation showing the purchase and destination account. Signing in or adding a login method alone does not share it. Deferring sharing preserves successful sign-in and valid local App Store access. Sharing does not change the purchase contract or original transaction owner, and does not automatically transfer purchases to another account.
-
Purchase restoration and sharing with an App account are different actions. Purchase sharing is not a Created Data storage or sync service. Multiple subscriptions are not automatically merged or cancelled.
-
Request App account deletion from Account in the settings of a supported version, followed by identity verification and final confirmation. Check processing status after acceptance. If the action is unavailable or verification or processing cannot be completed, use the contact page.
-
Account deletion stops sign-in and shared Additional Features through that account. It does not delete Created Data on the device, purchase contracts, or accounts with external login providers. Valid local App Store purchases and restoration are evaluated separately. If cancellation is needed, review the purchase provider's management procedure before deleting the account.
-
Purchase ownership, sharing, audit, and similar records retained after deletion, and deletion requests to external providers, are handled under the Privacy Policy. Creating a new account does not automatically transfer the original purchases or sharing records to it.
Article 6 Intellectual Property Rights and Use of Assets
-
Rights in the App's programs, design, logos, Bundled Assets, and other components belong to the Operator or the respective rights holders. Users are granted the right to use them within the applicable license.
-
Sharing a Project that includes Bundled Assets is permitted. However, extracting Bundled Assets and distributing or selling them is prohibited. Bundled Assets that have individual conditions of use are governed by those conditions. Bundled Assets that require license attribution are listed in the in-app license display.
-
Rights in Created Data that the user owns do not transfer to the Operator by reason of using the App. The Operator also does not receive a blanket license to use Created Data for advertising or promotion merely because the App is used.
-
Users shall secure the rights needed to use, process, export, and share Additional Assets. Users shall review and comply with each asset's conditions regarding commercial use, credit display, modification, redistribution, and similar matters. Users shall not infringe copyrights, trademark rights, publicity rights, privacy, or other rights of third parties. Obtaining an entitlement to Additional Features does not lift restrictions placed on third-party assets.
-
The ability to import an asset, or the display of rights information in the App, does not constitute permission or a warranty of rights by the Operator. If a Project contains assets, the scope permitted for exporting images and for sharing the Project file may differ.
-
Within the rights and conditions of use that apply to each asset, users may use exported images for commercial or non-commercial purposes, whether or not they use Additional Features. The Operator does not require an additional fee or SceneDrafter credit display for the use of exported images themselves.
-
Open-source software and other third-party software are governed by their respective licenses. These Terms do not limit rights granted by those licenses or by applicable law.
Article 7 Saving and Backup
- Created Data is saved on the user's device. Users shall save and back up Created Data as needed.
Article 8 Prohibited Conduct
-
Users shall not:
(1) violate law or infringe the rights of others.
(2) gain unauthorized access to the App or purchase-management functions, forge purchase information, or obtain entitlements improperly.
(3) intentionally interfere with the operation of the App or related services.
(4) copy, sell, or redistribute the App or Bundled Assets except as permitted by the applicable license.
(5) reverse-engineer, decompile, disassemble, or otherwise analyze the App.
-
Conduct permitted by applicable law or by licenses of third-party software is excluded from the prohibitions above.
Article 9 Provision of Updated Versions
-
The Operator may provide updated versions of the App for bug fixes, addition or change of features, security responses, adaptation to operating systems or third-party services, and similar purposes.
-
If an update would materially change the conditions of provision, the Operator will provide notice of the content and timing in the App or on a public page, with a reasonable period of advance notice. If an emergency response is required, notice will be given promptly afterward.
Article 10 Suspension or Termination of Provision of the App
-
The Operator may suspend or terminate distribution of the App. If suspension or termination is planned, the Operator will provide notice of the content and timing in the App or on a public page, with a reasonable period of advance notice. If an emergency response is required, notice will be given promptly afterward.
-
Suspension or termination of distribution of the App does not, by itself, stop use of the App already installed.
-
Regardless of whether distribution continues, features that require network communication, such as confirmation of entitlements, may become unavailable due to maintenance, outages, interruption of third-party services, or other circumstances. As a result, use of Additional Features may be restricted even in an already installed copy of the App.
-
If provision of Additional Features is materially affected during a subscription's valid period due to an update under the preceding Article or a cause under this Article, the Operator will provide notice of the impact and its response policy, and will take necessary measures in accordance with the procedures of the purchase provider and applicable law. The preceding Article and this Article do not allow the Operator, at its discretion, to exclude users' statutory rights.
Article 11 Warranty
-
If Additional Features purchased for a fee do not conform to the content indicated at the time of purchase in a supported usage environment, the Operator will, depending on the nature of the issue, fix it, provide a workaround, or handle a refund request in accordance with the procedures of the purchase provider.
-
The warranty in the preceding paragraph does not apply to Basic Features or Additional Features provided free of charge, and the Operator makes no warranty regarding them.
-
If the Operator is liable for damages in connection with Additional Features purchased for a fee due to the Operator's slight negligence, the upper limit is the purchase price of the paid item that caused the damage, or, for the relevant subscription, the fees the user actually paid during the 12 months before the damage occurred. This upper limit does not apply to damages related to free use, or where the upper limit would be zero.
-
This Article and the next Article do not exempt or limit liability arising from the Operator's willful misconduct or gross negligence, or liability that cannot be exempted or limited by law.
Article 12 Disclaimers
-
Except for the warranty in Article 11, the Operator does not warrant that the App will work with every usage environment or asset, that it will continue to operate without defects, or that displayed or exported results will meet the user's particular purposes or expectations.
-
Use, publication, and sharing of Created Data are the user's responsibility. Disputes with third parties and other trouble arising from these acts shall be resolved by the user at the user's own responsibility and expense, and, except where the cause is attributable to the Operator, the Operator assumes no liability whatsoever.
-
The Operator is not liable for damages arising from loss or corruption of Created Data, communication failures, interruption of third-party services, or other causes not attributable to the Operator.
-
The Operator is not liable for damages arising from earthquakes, typhoons, floods or other natural disasters, war, riots, or other force majeure, where the cause is not attributable to the Operator.
Article 13 Handling of Personal Information
- User information is handled in accordance with the separately established Privacy Policy. Authentication uses supported Google, Apple, and Unity services; purchase management uses the Store of purchase and RevenueCat; and authentication, purchase verification, sharing, and associated server processing use Cloudflare. Created Data is not automatically uploaded to the Operator's or RevenueCat's servers.
Article 14 Changes to the Terms and Governing Law
-
The Operator may change these Terms in accordance with applicable law. The fact of the change, the changed content, and the effective date will be announced on this site's Terms of Use page or in the App. Changes that materially affect users' rights and obligations will be announced with a reasonable period of advance notice. However, any advance notice or consent required by law will be provided or obtained.
-
If any part of these Terms is held invalid, the remaining parts continue to apply to the extent permitted by law.
-
These Terms are governed by the laws of Japan. However, this does not exclude the application of mandatory consumer-protection provisions that apply based on the user's place of residence or similar factors. The court with jurisdiction over disputes follows applicable law. Matters relating to contracts with Apple and the Standard EULA follow their respective provisions.
